There is no UK statute that prohibits magnet fishing as an activity. The restrictions that apply to it come from waterway byelaws and landowner permission rather than from criminal law.
That distinction matters, because the single largest waterway network in England and Wales does not permit it — which catches most people out.
The Canal & River Trust does not permit magnet fishing
The Canal & River Trust is responsible for over 2,000 miles of canals and rivers across England and Wales — by its own figures, around 1,588 miles of canals and 465 miles of rivers and feeders, plus some 1,710 miles of towpath. According to the Trust's published guidance, magnet fishing is not permitted anywhere on that network.
The basis is the General Canal Byelaws, which prohibit dredging or removing material from a canal without authorisation. The Trust states that it does not issue permits for magnet fishing and operates no application process for one.
The reasons it gives are practical rather than bureaucratic:
- Recovered scrap creates navigation hazards for boats
- Risk to the person doing it and to passers-by on narrow towpaths
- Metal abandoned on towpaths after sessions
- Damage to canal infrastructure and historic features
That last point about abandoned scrap is worth sitting with. A significant part of why access has tightened in the UK relates to behaviour rather than to the activity itself.
Where might you be able to magnet fish in the UK?
Where you have permission from whoever controls the water. In practice that means:
- Private land with the owner's consent. This is the most straightforward route and the one most UK magnet fishers use.
- Waterways outside the Canal & River Trust network. Some rivers, lakes and docks fall under other bodies — local councils, the Environment Agency, private navigation companies, port authorities. Each sets its own rules, and those rules differ.
- Scotland operates under a separate legal framework, including different access provisions. Check with the relevant authority rather than assuming the position in England applies.
Permission to be somewhere is not the same as permission to remove material from the bottom. Ask about the second one specifically, and get the answer in writing.
What has to be reported
Anything dangerous. Firearms, ammunition and ordnance are recovered from British waterways with some regularity, particularly near former industrial and military sites. Do not move it. Move away and call 999.
Anything that may qualify as treasure. Under the Treasure Act, certain finds — broadly, old precious-metal objects and coin hoards — must be reported to the local coroner. Failing to report a qualifying find is a criminal offence under that Act. If you are unsure whether something qualifies, report it and let them make the assessment.
Anything of archaeological interest is worth recording with the Portable Antiquities Scheme even where it falls outside the Treasure Act.
Before you go
- Check whether the water is Canal & River Trust managed. Their website maps the network.
- Identify who does manage it and ask them directly, in writing.
- Take everything you recover away with you. Scrap goes to a recycling centre, not the bank.
- Rinse mud off the path before you leave.
The UK is one of the more restricted markets for this hobby, and the direction of travel has been towards more restriction rather than less. The magnet fishers who keep access tend to be the ones who leave sites cleaner than they found them.
